			<content:encoded><![CDATA[<p>Que puedo hacer si veo una foto mía desnudo o en top less colgada en Internet? ¿Y si no es desnuda, pero también quiero que la retiren?</p>
<p>Intentar localizar al propietario del dominio (tal vez en who is) y dirigirte a él paa que retire esa imagen y, si no lo hace, denunciarlo ante la policía. Si el titular del dominio (no el servidor) está en el extranjero, tal vez tenga en su aviso legal cómo reclamar (p.ej. www.youtube.com tiene la vía de la política de privacidad y la del copyright). El último, y más efectivo recurso, la denuncia policial: el Grupo de delitos telemáticos o la Brigada de de Investigación Tecnológica</p>
<p>Depende, no podrás si por ejemplo si la captación de tu imagen es accesoria a la imagen que concretamente se está tomando, y se está en un lugar público, pues no vas a tener mucho que hacer. En concreto, la Ley dice que el derecho a la propia imagen no impedirá:</p>
<p><span id="more-131"></span></p>
<p>a) Su captación, reproducción o publicación por cualquier medio cuando se trate de personas que ejerzan un cargo público o una profesión de notoriedad o proyección pública y la imagen se capte durante un acto público o en lugares abiertos al público.</p>
<p>b) La utilización de la caricatura de dichas personas, de acuerdo con el uso social.</p>
<p>c) La información gráfica sobre un suceso o acaecimiento público cuando la imagen de una persona determinada aparezca como meramente accesoria. Las excepciones contempladas en los párrafos a) y b) no serán de aplicación respecto de las autoridades o personas que desempeñen funciones que por su naturaleza necesiten el anonimato de la persona que las ejerza.</p>
<p>¿Qué castigo penal puede caerle a alguien que publique mi foto desnuda en una playa?</p>
<p>Si entendemos que la fotografía en si supone una lesión a la dignidad de la persona, atentando contra su propia estimación, y es publicada en Internet, entonces podríamos incluso hablar de una &#8220;injuria&#8221; con el agravante de publicidad, pero en resumen, las acciones judiciales que existen hoy, conllevarían penas de hacer (más bien cesar en la publicación) y multas económicas.</p>
<p>¿ Si es un vídeo, ¿es más grave o es lo mismo?</p>
<p>Es lo mismo a efectos de posibilidades de defensa judicial, pero, dependiendo del contenido podría intentararse que el juez valorara una mayor gravedad (la Ley habla de captación, reproducción o publicación por fotografía, filme, o cualquier otro procedimiento de la imagen de una persona).</p>
<p>¿En qué delitos incurre alguien que cuelga la foto robada de otra persona en una playa?</p>
<p>Me remito a lo anterior, se podría hablar de un delito de injurias, e<br />
incluso, dependiendo de si además de estar desnuda está en situación más comprometida, incluso de un delito de revelación de secretos, con penas de prisión de entre 2 y 5 años.</p>
<p>Si me tapan la cara, ¿tienen derecho a poner una foto desnuda mía, aunque para mis amigos sea reconocible?</p>
<p>Si te tapan la cara de tal forma que se dificulte la identificación de la persona, entonces no hay problema, pero, si resulta que la persona tiene un tatuaje inconfundible, y se publica la fotografía en la Intranet del trabajo, entonces la identificación de la persona es obvia aunque no se le vea la cara.</p>
<p>La mayoría de lugares donde se cuelgan estas fotos están en países remotos, ¿cómo se soluciona eso?</p>
<p>La colaboración de la Interpol es imprescindible, aunque, suele estar más implicada cuando las imágenes son de menores. En cualquier caso, la denuncia policial es el primer paso, pues abre la actuación judicial, única forma legal de lograr la retirada de contenidos de la Red. Desde la AI estamos insistiendo continuamente en la necesidad de la especialización de nuestros juzgadores en materia de nuevas tecnologías.</p>
<p>Una vez subidas a Internet, ¿esas fotos pueden pasar de página en página de forma que sea imposible retirarla del todo?</p>
<p>Si, no sólo que se vaya &#8220;linkando&#8221; de una a otra web, sino que además quedan las memorias caché y las hemerotecas virtuales. Como digo, eso es especialmente grave cuando hay menores implicados, por eso es tan importante que en los colegios e institutos se explique a los chavales que algo así no es una broma divertida, que es muy grave y, que sufrirlo, puede llevarte incluso a serios problemas psicológicos.</p>
<p>Aparte de cerrar las páginas, ¿qué tipo de indemnización se puede pedir en estos casos?</p>
<p>La valoración económica se hará en función de lo que estime el afectado en principio, y de lo que acepte el juez. La Ley dice que la indemnización se extenderá al daño moral, que se valorará atendiendo a las circunstancias del caso y a la gravedad de la lesión efectivamente producida, para lo que se tendrá en cuenta en su caso, la difusión o audiencia del medio a través del que se haya producido. También se valorará el beneficio que haya obtenido el causante de la lesión como consecuencia de la misma.</p>

			<content:encoded><![CDATA[<p>Una de las claves del éxito Google, además de haber creado un notable <a href="http://google.dirson.com/o.a/google-web/">buscador web</a>, ha sido que la confianza de los usuarios se la ha ganado sin invertir (al menos, los primeros años) ni un sólo dólar en campañas publicitarias, y obteniéndola a través del &#8216;boca-oreja&#8217; entre aquellos que utilizan sus herramientas, y que recomiendan su uso a sus amigos y familiares.</p>
<p>Como comentábamos hace unos meses, <a href="http://google.dirson.com/post/3061-confianza-dificil-conseguir-perder/">la confianza es fácil de perder</a>, y una de las causas es que los usuarios comiencen a percibir que las herramientas no funcionan como se desea. Por ello, los responsables de los servicios de Google están permanentemente leyendo y escuchando las opiniones de estos usuarios, y una manera de hacerlo en la nueva WWW es monitorizando la blogosfera.</p>
<p>Adam Darowski es un blogger de Boston cuyo blog tiene cierta relevancia, y que el pasado mes de marzo viajó a Texas para acudir a <a href="http://2007.sxsw.com/interactive/">unas conferencias</a>. Según cuenta en <a href="http://www.darowski.com/tracesofinspiration/2007/03/09/the-good-the-bad-and-the-sad-day-one-of-sxswi-after-the-panel/">este post</a>, acudió a &#8216;<a href="http://google.dirson.com/post/2041-google-transit/">Google Transit</a>&#8216; para que éste le recomendase las mejores conexiones, en medios de transporte públicos, para llegar desde el lugar donde se celebraba el evento hasta su hotel.</p>
<p>Darowski, con gran asombro, descubrió cómo se le indicaba una ruta en la que la última parada estaba situada a casi un kilómetro del hotel, sugiriéndole que, desde ese punto hasta el hotel, realizase un paseo andando. Además, en ese trayecto tendría que pasar una vía de tren y una autopista (ver <a href="http://farm1.static.flickr.com/177/416123146_1973852f91_o.png" rel="lightbox">captura</a> de la ruta recomendada).</p>
<p>&#8220;Um. ¿Soy Superman?&#8221;, se preguntaba irónicamente. &#8220;¿Cómo demonios espera Google que lo consiga?&#8221;.</p>

<p>Joe Hughes es uno de los responsables de &#8216;Google Transit&#8217;, y leyó la queja. Y para disculparse por el error del servicio, le escribió una carta manuscrita: &#8220;Estimado Superman. Lamentamos que Google Transit te enviase a esa excursión, y queríamos que supieses que tu queja nos ha hecho que mejoremos el servicio, para intentar que los recorridos a pie desde los puntos de inicio y fin de las rutas sean mucho más aceptables&#8221;.</p>

<p>What happened after December? Well, Google stopped giving almost every Google Checkout user twenty dollars just for shopping. Like I said before, if you have to pay users to use your service, then it doesn’t deserve to succeed, and shoppers are agreeing. I don’t understand why Google Checkout needs to exist on websites like Buy.com, that have no problem processing credit card orders normally, and Google needs to find an excuse for their system. At least PayPal has a bank account.</p>

			<content:encoded><![CDATA[<p>Yes, yes all this talk about Web 2.0 is fine. But what about all the differences you see on the web because of it. Does anybody remember what the web looked like in 1999 when IE 5 was all the rage and it came bundled up with Windows 98 SE.</p>
<p>Apart from the most obvious things like better design, usability along with standards there are 7 things about the way a website just looks and feels different now because of most of the below annoyances that have been phased out by better designers. Here’s the breakdown -</p>
<p><strong>Best Viewed In</strong> &#8211; Remember that phrase, you would see it everywhere! This site is “Best viewed in IE 5.5 or Netscape 6″ coupled with the screen resolution also being stated. This warning was enough for me to just leave the site and never never return. The only sites that still use that wording are the ones that haven’t updated their sites in years, or still employ the same people who run Win 98 SE on their computers. Hello! People it’s 2007…see we have this thing called Firefox, you can even see it from the sky. In fact here is a community message from Pizza Hut.</p>
<p><strong>Get Flash Player </strong>- I’m so glad that Web 2.0 sites don’t have splash pages that say please download AJAX and CSS before proceeding to view our site. That would be a sweet parody though for whoever has time to kill.</p>
<p>But yeah, Web 2.0 has done away with giving you instructions on how to download it due to the fact that everybody put those get flash player badges on their sites, so we don’t need to see it anymore. 98% of the internet population has flash installed.<br />

<strong>Tables </strong>- With the advent of CSS the web just got more cleaner. There are still some people who refuse to give up using tables to design a web layout, and then there are those that you are just left asking yourself &#8211; Why? Pixel perfect positioning with a lightweight web page are just some of the benefits of using CSS to build your websites.</p>
<p><strong>Click here to Enter/Launch</strong> &#8211; The dreaded splash page that had all the first two requirements was not bad enough &#8211; they had to add another click to the experience. One click too many for me. When people visit your site they want to see, read and experience not told to do a bunch of things before they can view your site.</p>
<p>That’s like going to a restaurant and the chef tells you to cut the potatoes so he can fry them and then serve it to you. A great many sites still do practice this evil and they are mostly in the shopping, fashion segment.</p>
<p>The only good thing about a splash page, in the example of fashion, is the language redirection of the visitor.</p>
<p><strong>Flash Intros</strong> &#8211; Oy! Yay! Yay! I’ll admit I’m guilty of this too. Making those swishy swashy flash intros to please clients of some zippipty chappada pad pa in their sites was a requirement. I have only one company/man to solely blame for this trend. Eric Jordan of 2Advanced.com which brings me to the next one…</p>
<p><strong>Loading please wait…</strong>Sigh! Flash you seem to dominate this post. Waiting forever on those 56K modems a couple of years ago was AGONY! Not only that but then sometimes the designer would get creative and break the flash apart and give the files various loading sequences and name them like so &#8211; getting navigation…navigation done…getting sound…sound done…finalizing layout…layout created…oh shut the heck up! Exit…</p>
<p><strong>Resizing Browsers</strong> &#8211; Imagine if you went to digg and they would automatically resize your browser and then you jumped over to delicious and they would do the same, then CNN and so on and on. The chances of you ever visiting those sites again would drop to 0 in a heartbeat.</p>
<p>I could go on and on about more stuff but I want to encourage you to comment and tell me the stuff that I have missed or didn’t think about.</p>

			<content:encoded><![CDATA[<p>Tener un ordenador conectado a Internet puede ser la principal causa de que nuestra productividad caiga en picado. Y es que Internet es demasiado entretenido.  A mi me ha pasado muchas veces, y creo que ya es hora de hacer algo al respecto.</p>
<p>Con el tiempo uno sufre lo que se acaba llamando por <strong>infotoxicación</strong> o <em>intoxicación por exceso de información</em> y no es otra cosa que tener demasiados <strong>focos de distracción</strong> que hacen que sea imposible centrarse en una sola cosa. Algunos métodos que uso para minimizar lo máximo posible estos focos (y con cierta eficacia) son:</p>
<ol>
<li><strong>Desactiva la descarga automática del email</strong>. El icono del correo en la bandeja con un bonito número es una llamada muy poderosa a leer el correo pendiente.
<p>Esto <strong>también se aplica con el lector de feeds</strong> y cualquier programa similar, la idea es tener que darle a “descargar ahora” manualmente <strong>cuando a ti te interese</strong>.</p>
<p>De la misma forma, <strong>desactiva las notificaciones sonoras</strong>: a poco que te intentes concentrar se vuelven un incordio y te hacen pensar “tengo que revisar los correos/feeds pendientes”.</li>
<li><strong>La mensajería instantánea es un acoso continuo</strong>. El no estar conectado es deseable, pero si no es posible intenta configurarlo lo mejor posible:
<ul>
<li><strong>Desactiva las notificaciones sonoras</strong>: se aplica el tercer párrafo del primer punto exactamente igual.</li>
<li>Notificaciones visuales <strong>sólo una vez</strong>. En esto Kopete por defecto es muy agradable y un ejemplo a seguir, cuando te hablan aparece un cuadro para contestar/ignorar pero cuando minimizas la conversación <strong>no vuelve a aparecer el recuadro</strong> cuando te dicen algo nuevo a no ser que sea otra persona.</li>
<li>Ponte en <strong>estado ocupado</strong>: hay gente que “te molestará” igualmente (a veces ni te das cuenta del estado de la otra persona) pero algunas personas lo respetan y evitan hablarte <em>por tonterias</em>.</li>
</ul>
</li>
<li><strong>Música: depende</strong>.
<p>Por experiencia algunas personas “funcionan” mejor con un estilo de música que con otro, incluso sin música. El único inconveniente es al trabajar en grupo evitar elegir estilos que a unos les distraigan y a otros no.</p>

<li><strong>La noche es tu aliada</strong>. Soy un hombre nocturno. Si cualquier foco de distracción puede hacer perder la concentración y por tanto la productividad, entonces el ruido del día es perfecto para ello.
<p>La noche es tu aliada, sobretodo cuando el único ruido que se oye es el de tus manos acribillando el teclado. Además puede resultar una fuente de inspiración enorme coger un portátil, subirse al tejado y ponerse a escribir a la luz de la luna llena… aún a riesgo de que empiece una lluvia abundante y la inspiración se convierta en una gripe de 7 días con medicina o una semana sin medicinas…</p>
<p>Una solución alternativa seria <strong>tener un cuarto insonorizado</strong> pero además de ser una solución que no todo el mundo puede costearse no es solución cuando a la quinta vez que te llama tu familia y no contestas entra abriendo la puerta de golpe y hablando a grito pelado, desde luego no hay duda: la noche es tu aliada.</li>
<li><strong>Entorno agradable</strong>. Puede sonar obvio, pero algunas personas tienen un sitio para trabajar <strong>muy mal acondicionado</strong>: temperatura inadecuada (demasiado calor de día y demasiado frío de noche), poco espacio, un monitor sin base (nada elevado, literalmente a la altura del teclado) y mi favorita: una silla nada cómoda; a ser posible con ruedas, estrecha y con muchas almohadas para que al sentarte te escurras hacía delante, la silla hacía atrás y tu trasero hacía el centro de la tierra.</li>
<li><strong>Banea YouTube</strong>. No es broma, me estoy planteando seriamente hacerlo o un script en greasemonkey que ponga una alerta <em>“esta usted apunto de entrar en YouTube, esto supone una acción muy peligrosa para su productividad y una (feliz) perdida del poco tiempo que tiene disponible”</em> xD.</li>
</ol>
<p>A modo de resumen la idea queda clara: comodidad, interferencias del exterior mínimas, <em>la familia como los trastos, pocos y lejos</em> y evitar ciertos usos del software.</p>

			<content:encoded><![CDATA[<p>Well, that depends on three main things, the length and complexity of your password, the speed of the hacker’s computer, and the speed of the hacker’s Internet connection.</p>
<p>Assuming the hacker has a reasonably fast connection and PC here is an estimate of the amount of time it would take to generate every possible combination of passwords for a given number of characters. After generating the list it’s just a matter of time before the computer runs through all the possibilities &#8211; or gets shut down trying.</p>
<p>Pay particular attention to the difference between using only lowercase characters and using all possible characters (uppercase, lowercase, and special characters &#8211; like @#$%^&amp;*). Adding just one capital letter and one asterisk would change the processing time for an 8 character password from 2.4 days to 2.1 centuries.</p>

<p>Remember, these are just for an average computer, and these assume you aren’t using <em>any word in the dictionary</em>.  If Google put their computer to work on it they’d finish about 1,000 times faster.</p>
<p>Now, I could go on for hours and hours more about all sorts of ways to compromise your security and generally make your life miserable &#8211; but 95% of those methods begin with <em>compromising your weak password</em>.  So, why not just protect yourself from the start and sleep better at night?</p>
<p>Believe me, I understand the need to choose passwords that are memorable. But if you’re going to do that how about using something that no one is ever going to guess AND doesn’t contain any common word or phrase in it.</p>
<p>Here are some password tips:</p>
<ol>
<li>Randomly substitute numbers for letters that look similar. The letter ‘o’ becomes the number ‘0′, or even better an ‘@’ or ‘*’. (i.e. &#8211; m0d3ltf0rd… like modelTford)</li>
<li>Randomly throw in capital letters (i.e. &#8211; Mod3lTF0rd)</li>
<li>Think of something you were attached to when you were younger, but DON’T CHOOSE A PERSON’S NAME! Every name plus every word in the dictionary will fail under a simple brute force attack.</li>
<li>Maybe a place you loved, or a specific car, an attraction from a vacation, or a favorite restaurant?</li>
<li>You really need to have different username / password combinations for everything. Remember, the technique is to break into anything you access just to figure out your standard password, then compromise everything else. This doesn’t work if you don’t use the same password everywhere.</li>
<li>Since it can be difficult to remember a ton of passwords, I recommend using <a href="http://roboform.com/?affid=onema">Roboform</a>. It will store all of your passwords in an encrypted format and allow you to use just one master password to access all of them. It will also automatically fill in forms on Web pages, and you can even get versions that allow you to take your password list with you on your PDA, phone or a USB key. <li>Once you’ve thought of a password, try Microsoft’s <a href="https://www.microsoft.com/athome/security/privacy/password_checker.mspx">password strength tester</a> to find out how secure it is.</li>

In this photo I appear with international model Roberta Murgo, a 19 years old brazilian girl, who began her career two years ago, appearing two times in the brazilian version of Playboy Magazine.</span></p>

The first <a href="http://www.google.com/search?hl=en&amp;lr=&amp;rls=GGGL%2CGGGL%3A2006-40%2CGGGL%3Aen&amp;q=roberta+murgo&amp;btnG=Search" target="_blank" title="Google results for Roberta Murgo">result from a &#8220;Roberta Murgo Google search&#8221;</a> is from my <a href="http://www.flickr.com/photos/pics2die4" target="_blank" title="PICS2DIE4.com´s Flickr Account">Flickr account</a>, followed by my personal photo site called <a href="http://www.pics2die4.com" target="_blank" title="PICS2DIE4.com">PICS2DIE4.com</a>  </span></p>
<p class="flickr-frame">Some important and high traffic blogs and <a href="http://www.fhm.com/bigeye/" target="_blank" title="FHM Magazine">FHM Magazine</a> linked directly to <a href="http://www.pics2die4.com/gallery/v/fashion/robertamurgo/" target="_blank" title="Roberta Murgo´s Gallery @ PICS2DIE4.com">Roberta Murgo´s Gallery</a> @ PICS2DIE4.com collapsing my server in one day.  Traffic statistics reported 75 hits per second making the site unsurfable&#8230;    I was amazed, because after one year of life of <a href="http://www.pics2die4.com" target="_blank">PICS2DIE4.com</a> , I only had 12,000 visits, and in the last 2 days I almost got 31,000 visits.    That´s the power of a pretty face.  I had to change some URLs to get my server alive again.  By the time I´m writing this post, PICS2DIE4.com got <a href="http://www.sitemeter.com/stats.asp?site=sm9pics2die4" target="_blank" title="Sitemeter Statistics for PICS2DIE4.com">43,331 visitors</a>.  I´m already planning in working again with Roberta, so I hope to have a more powerful server in the future&#8230;.</p>
